Boutic Caffè Conditions of Sale

The offer and sale of products via the HTTPS://WWW.CAFFEBOUTIC.IT/NEGOZIO/ site are governed by the following General Terms and Conditions of Sale. The General Terms and Conditions of Sale are formulated in accordance with the regulations on off-premises contracts and in particular with the provisions of Legislative Decree. 6 september 2005, n. 206 (Consumer Code).

Contract Parties
The parties to the contract are as follows:
– Boutic Caffè Sas di Di Feo Paolo & C. with registered office in Turin, Via Monginevro 8/b, Company Register of the Turin Chamber of Commerce, Tax Code and VAT number 09967980013.
– Customer: the final consumer, i.e. the natural person acting for purposes outside his or her business and professional activity, identified through the HTTPS://WWW.CAFFEBOUTIC.IT/NEGOZIO site, who has placed an order accepted by Boutic Caffè.

Application and Amendment of the General Terms and Conditions of Sale
By placing an order in the manner provided, the Customer declares that he/she has read all the information provided during the purchase procedure and fully accepts the General Terms and Conditions of Sale. Boutic Caffè reserves the right to vary the General Terms and Conditions of Sale by giving notice on this page of the site. The General Terms and Conditions of Sale applicable are those in force at the time an order is placed. Any changes will be effective after publication on the site.

Registration at
Registration with username and password is optional. If the customer does not wish to register, he/she may still conclude a purchase: only the data required for delivery and possible invoicing of an order will be requested.

Characteristics and prices of products or services
Images of products may not be perfectly representative of their characteristics.
Products are offered at the price indicated on the site on the date an order is placed.
Coffee products are removed from sale 4 months before the expiry date.
Prices include VAT, which will be detailed on the purchase invoice for the product, if issued.
Prices do not include transport and delivery costs, which are however indicated in the final section before sending an order and specified in the order confirmation sent by e-mail to the Customer.

Placement of orders
Orders can only be placed from and to the following territories: Republic of Italy, Republic of San Marino, Vatican City.
Orders are subject to minimum quantity restrictions and are offered subject to stock availability.
Where they exist, promotional codes offered by Boutic Caffè are only valid for the products and during the period indicated. Promotion codes are non-refundable and non-cumulative. To take advantage of discounts and/or offers linked to promotional codes, the promotional code must be entered in the space provided when validating an order on the site. In case of forgetfulness, an order cannot be cancelled or renewed in order for the promotion code to be taken into account.
Orders from persons under the age of majority will not be accepted
The steps to place an order and to conclude the purchase contract are clearly highlighted in the sequence of pages on the site through explanatory text and graphics.
After confirmation of payment, the order may no longer be cancelled or modified.

Confirmation of receipt of an order and acceptance of the order
Upon receipt of an order, Boutic Caffè will automatically send a confirmation of receipt by e-mail, in which all details of the order will be summarised. Following the receipt of an order, Boutic Caffè will check the availability of the ordered product and only after this check will communicate its acceptance of an order and the shipment of the product.
In the event that Boutic Caffè is unable to process an order received, it will notify the Customer without delay.
Any right of the customer to damages or compensation as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance of an order is excluded.

Accepted payment methods
Boutic Caffè only accepts payment via the systems listed below:
– PayPal: an online payment system that allows any business or consumer with an email address to send and receive payments, subject to registration. Payment is made through the PayPal payment platform.
– Credit card (American Express, Visa or Mastercard); through the Pay Pal payment platform. The total amount of an order will only be charged when the products are actually shipped.
– Bank Transfer

Shipment of products
Product shipments and deliveries can only be made within the territories of the Italian Republic, S. Marino and the Vatican City. Boutic Caffè will only ship purchased products to the destination specified in an order. We do not accept shipments to P.O. boxes.
Boutic Caffè shall ship the products ordered by the Customer, by courier, to the address indicated by the Customer, approximately within 48 working hours of acceptance of the order. Delivery is generally within 4 working days. The times given for receipt of goods are approximate.
Delivery costs are invoiced on the basis of the rates indicated on the site or communicated by Customer Service on the date an order was placed.
The courier is responsible for delivery. Boutic Caffè undertakes to collect any reports of non-delivery or delayed delivery of products through the Customer Service and, where appropriate, to assist the Customer in protecting its rights as required by law.

Acceptance of the product by the customer
Any damage to the packaging and/or the product or the mismatch of the number of packages or indications must be immediately notified by making a specific indication on the delivery note. By signing the courier’s document, the Customer certifies the actual exterior integrity of the product and the conformity of the delivery.
Any problems concerning the actual physical integrity, correspondence or completeness of the products received must be reported within 10 working days of delivery by sending an e-mail to INFO@CAFFEBOUTIC.IT or by calling 011 4474404.

An invoice will be issued for each order of the private customer who has entered his tax code, and for each order of the professional customer or company with p. Iva. Invoices are issued on the basis of the information provided by the customer when placing an order. Nessuna variazione in fattura sarà possibile dopo l’ emissione della stessa. When ordering, you must indicate whether the shipping address is different from the billing address. If the private customer chooses not to enter his tax code, or the professional or corporate customer his p. VAT, Boutic Caffè will not issue an invoice or certify payment by issuing a receipt or fiscal receipt (Art. 22, para. 1 DPR 633/72 and Art. 2, lett. oo) DPR 696/96) ‘

Right of Withdrawal and Rules for Return
lbIn execution of the provisions of Legislative Decree. 21 February 2014, No. 21 implementing Directive 2011/83/EU on consumer rights, the customer may return the purchased product and obtain a refund of the purchase sum actually paid.
The right of withdrawal may be exercised within 14 days of receipt of the product in the following ways:
1. Before the expiry of the aforementioned deadline, the Customer shall send a registered letter with acknowledgement of receipt to Boutic Caffè or make another express declaration to that effect: Notice may be sent, within the same deadline, by e-mail to INFO@CAFFEBOUTIC.IT, or by telephone to 011 4474404.
2. The Customer shall subsequently be contacted by Boutic Caffè to take charge of the return.
The return of the product shall take place within 14 days from the date of receipt of the notice of withdrawal.
The refund of the price paid to purchase the product includes shipping costs.
In the event that the Customer sends back products after the aforementioned deadline or in the case of products that have been opened and/or partially used and are not suitable for return, the right of withdrawal does not apply and Boutic Caffè will return the purchased goods to the Customer, charging him for the shipping costs.
Subject to the above limitations, Boutic Caffè shall refund the amount actually paid by the Customer within 14 days of receipt of the notice of withdrawal by means of a Pay Pal credit note.

Applicable law and place of jurisdiction
The sale of products and/or services takes place in the territory of the Italian State and is subject to the laws in force in the Italian Republic. Jurisdiction for the resolution of any dispute shall be that provided for by Italian law in force at the time of the conclusion of the contract.
